The United Arab Emirates has enacted Federal Decree-Law No. (41) of 2024, introducing a revised Personal Status Law, which came into effect on Tuesday, April 15, 2025. This comprehensive reform modernizes family law, with a focus on gender equality, child welfare, and individual rights within marriage.
Key Highlights of the New Law:
Independent Financial Status of Spouses

Each spouse is recognized as having separate financial independence.

A wife has full freedom to manage her property, and the husband cannot dispose of her assets without her consent.

If either spouse contributes to the development of shared assets or property, they must consult the other party or their legal heirs.
Marriage Provisions

The legal age for marriage is now 18, though the Cabinet may allow exceptions under special circumstances.

Minors can independently handle marriage-related procedures without the need for a legal guardian or trustee.

A woman has the right to marry a man of her choosing. If her guardian refuses to consent, the court can intervene and authorize the marriage.

Marriage contracts may include deferred dowry agreements, either in part or in full. If no deferral or timing is specified, the dowry becomes payable upon the wife’s request.
Child Custody and Welfare

The best interests of the child are central to all custody decisions.

The custody age is raised to 18 for both boys and girls (previously 11 for boys, 13 for girls).

Children aged 15 and older can choose which parent to live with.

In cases where the custodian is of a different religion, courts will determine custody based on the child’s well-being, replacing the older law that ended non-Muslim mothers’ custody at age five.
Legal Penalties and Protections
The new law introduces strict penalties for:

Misuse or misappropriation of a minor’s funds

Traveling with a child without proper authorization

Embezzling inheritance

Neglecting parental or financial duties
Offenders may face fines ranging from AED 5,000 to AED 100,000 or imprisonment.
Mutual Rights and Duties of Spouses

Spouses are legally obligated to treat each other with kindness, compassion, and respect.

Physical or emotional harm is prohibited, and neither spouse may withhold marital relations or refuse to have children without the other’s consent.

Husbands must provide fair financial support and equal treatment to multiple wives, if applicable.

Wives are expected to respect and support their husbands and breastfeed their children, unless there’s a valid religious justification not to.
