CDA Issues Final Warning to Bahria Town Over Alleged Encroachment of Public Land

The Capital Development Authority (CDA) has issued a show cause notice to M/s Bahria Town (Pvt) Ltd. over the alleged illegal commercial use of public amenity land in Bahria Enclave Housing Scheme, Zone-IV.

The authority has taken notice of reported encroachments on plots designated for parks, playgrounds, and open spaces, terming the move a violation of approved planning regulations.

According to the notice, the layout plan of Bahria Enclave-I, spanning 12,543.11 kanals, was approved in December 2020. A No Objection Certificate (NOC) was subsequently granted in April 2022, subject to specific terms and conditions. The land reserved for public amenities was transferred to the CDA in October 2022 following approval of the scheme.

The CDA observed that a family park and a multi-purpose playing field located at Park Road in Sector-A had allegedly been encroached upon. A marquee and restaurant have reportedly been constructed on the site and are being used for commercial purposes.

The authority stated that such use of amenity plots contradicts the approved layout plan and violates its rules and regulations.

The developer has been directed to remove the alleged violations, restore the parks and green areas in accordance with the approved plan, and submit a compliance report within seven days. The notice also seeks a written explanation from Bahria Town as to why legal proceedings should not be initiated under the CDA Ordinance 1960, ICT Zoning Regulations 1992, and the 2023 regulations governing private housing and commercial schemes in Islamabad.

CDA has warned that failure to comply within the stipulated timeframe may lead to demolition of illegal structures and cessation of land use through enforcement action, including the use of police force.

Costs incurred during the operation would be recovered from those responsible, and ex parte proceedings could be initiated in case of non-compliance. The developer has been offered an opportunity for a personal hearing within seven days.

Relevant CDA departments have been instructed to coordinate enforcement measures to ensure the removal of encroachments from land earmarked for public use.
