Selling Land in Margalla Hills Is Legal Again

The Islamabad High Court (IHC) has lifted the ban on the purchase, sale, registration, and transfer of properties in several localities of the federal capital, including Shah Allah Ditta, Sangjani, Sarai Kharbooza, and other designated areas. The ruling allows property transactions to resume in accordance with the law.

The decision was issued by Justice Muhammad Asif while allowing a petition filed by citizen Fazal Abbas. The court ruled that the restriction imposed on December 1, 2023, had been enforced without the approval of the competent authority and was therefore legally invalid.

In its judgment, the court directed the authorities to regulate all property transactions in accordance with the Capital Development Authority (CDA) Ordinance, Islamabad Capital Territory (ICT) regulations, and other applicable laws. The ruling emphasized that legal oversight of property dealings must continue under the existing regulatory framework.

The court also clarified that government authorities remain fully empowered to take action against illegal housing schemes, unauthorized constructions, and unlawful changes in land use. It stated that lifting the ban does not prevent authorities from enforcing the law against violations.

The judgment further reaffirmed that while lawful property transactions may proceed, enforcement agencies are free to initiate legal action against illegal housing projects and unauthorized developments in accordance with the relevant laws and regulations.
