KARACHI: The Karachi Metropolitan Corporation’s (KMC) Land Director has been issued a bailable warrant by the Sindh High Court (SHC) for failing to appear in court despite being ordered.
During the hearing, the court directed Najamuz Zaman to prepare a proposal that suggested ways to compensate the respondents in the KMC’s appeal.
According to the court, despite being served with a notice, the land director was not present. The KMC’s counsel stated that he had informed Zaman of the hearing but had no idea why the officer failed to appear.
A bailable warrant in the amount of Rs. 25,000 was issued for Zaman by the SHC division bench made up of Justices Irfan Saadat Khan and Zulfiqar Ahmed Khan, directing him to appear in court on November 2 with an explanation.
The details of the case reveal that the KMC had filed an appeal against the SHC judge’s decree in favor of the shopkeepers of the KMC-leased property on Abdullah Haroon Road.
According to the KMC, the shops were built on a drain in the Saddar area, and due to the collapse of the portion of the nullah, some of the shops facing Abdullah Haroon Road collapsed, while the rest of the property suffered cracks, for which they consulted court for the compensation.
The counsel of KMC stated that the respondents were lessees of the shops that were sold to them in an open public auction with the approval of the high court.
He further stated that since the respondents had no cause of action against the KMC, they were not entitled to any relief, asking the court to vacate the decree issued by the judge of SHC against the KMC.
