President Upholds Order Granting Due Share of Inherited Property to Sisters

ISLAMABAD: President Dr. Arif Alvi has upheld the Federal Ombudsman for Protection against Harassment of Women at Workplace (FOSPAH) orders to give 4 sisters their rightful share in the inherited property.

This right activates over the belonging to their deceased father after placing the property up for open auction/sale and dividing the proceeds among all the siblings.

The President issued these orders under the Enforcement of Women’s Property Rights Act, 2019, in response to a case where 4 sisters had complained to FOSPAH.

The complaint stated that their brothers had refused to give them their inherited right to share in the property of their deceased father and had prayed for their respective shares to be given.

Furthermore, the brother and other legal heirs of the deceased had signed a statement agreeing to enter into a peaceful settlement, which provided that the property in question, a house in Rawalpindi, would be evaluated by a commission appointed by FOSPAH to determine the market value/price of the said property.

The President noted this in his decision that every owner of the house would receive their fair portion according to the “shariah” share after determining the market worth of the property, and all costs would be subtracted from or adjusted for those who had spent properly.
