IHC Hears Plea Against CDA Cheif’s Appointment

ISLAMABAD: The Islamabad High Court heard a petition on Monday challenging the appointment of Capt (Retd) Noor-ul-Amin Mengal as Chairman of the Capital Development Authority (CDA).

The petition was filed by Riaz Hanif Rahi and cites the Federation of Pakistan and various government departments as respondents.

The petitioner argues that Mengal, a retired army officer, was appointed as Chief Commissioner of the Islamabad Capital Territory and then as Chairman of CDA, which goes against the provisions of the CDA Ordinance 1960.

The petitioner also argues that the appointment of an ex-officio member as chairman is not recognized by law and carries different meanings.

He further contends that the dual position held by Mengal is a breach of public trust and amounts to misconduct.

The petitioner has requested the court to declare the appointments as unlawful and to direct the Federal Government to appoint a senior, independent officer as Chairman of the CDA.
