IHC Issues Notice to DG Environment Over Bhara Kahu Bypass Project

ISLAMABAD: The Director General of Environment was called before the Islamabad High Court (IHC) on Monday in a matter involving the Bhara Khau bypass on the land of Quaid-e-Azam University (QAU).

According to the details, Justice Mian Gul heard the case from the petitioner’s attorney Kashif Malik, Quaid-e-Azam University’s attorney Nauman Pracha, CDA’s attorney Nazir Jawad, Additional Attorney General Munawar Iqbal Dogal, and others.

Furthermore, a meeting between officials from QAU and CDA was convened on November 13 to resolve the issue, to which the petitioner’s attorney claimed that by carrying on with the Bhara Kahu project, the stay order was violated.

Besides, the Environment Protection Agency noted in the report it submitted to the court that the CDA had been fined Rs. 1,000,000 for breaking the rules. After the fine amount was paid, he claimed that the agency would approve the project.

As per the sources, the court responded by saying that there was no clause in the constitution to offer conditional approval and that the agency would only be given approval if all the prior legalities are met.

The court adjourned the case till Nov 25 and remarked that the legal course would be followed without any hurry and that decision would be made as per the law.
