SHC Irked over KDA’s Failure to Remove Encroachments

KARACHI: On Monday, the Sindh High Court (SHC) expressed displeasure that encroachments on a Landhi amenity property had not been removed despite court orders for the Karachi Development Authority (KDA) to provide a compliance report.

According to sources, a division bench of the SHC led by Justice Nadeem Akhtar, was hearing a petition regarding encroachments on the Landhi amenity plot when it questioned a KDA official about why the court order had not been followed for 11 years.

The petitioner’s attorney claimed that although the court had mandated the removal of encroachments from the amenity plot in November 2011, the order had not been followed in letter and spirit.

Furthermore, KDA officer was also questioned by the SHC about the KDA’s activities during the previous 11 years and the reason the court’s decision had not been implemented.

Besides, the high court argued with the officer about how much more time the KDA would need to comply with the court order, after observing that the encroachments had still not been removed by the authority.

In response, the KDA official stated that a housing society had been established on the amenity land due to which it was not possible to take the relevant action since it might instigate people and residents.

The SHC asked whether a housing society could be established on amenity land, and ordered the KDA to produce a compliance report at the next hearing.
