The Council of Islamic Ideology (CII) has clarified that divorce happens even if the husband speaks the word ‘Talaq’ to his wife as a joke.
Chairman CII made these remarks during a meeting of National Assembly’s standing committee. The ruling came in reply to a question asked by MNA Mehmood Bashir Virk.
“Yes, divorce happens even if spoken as a joke,” Dr. Qibla Ayaz said.
The meeting convened under the chair of Riaz Fatyana to legislate on divorces and inheritance according to the sects.
Also attended by the Law Minister Dr. Farogh Naseem, the committee questioned if giving divorce was a crime in Sharia.
If that is so, the ministry will support this law; if it is not a religious crime, then we must refrain from such acts.
On a question related to the punishment on these offenses, Qibla Ayaz of CII said that the council could work in collaboration with the law ministry to finalize punishments.
Law Minister Farogh Naseem feared that this could lead to corrupt practices by police. Further discussion on the divorce bill will be made in the next committee meeting.
