The Islamabad High Court has taken up petitions filed by residents of Margalla Town and Orchard Scheme, during which a startling revelation emerged that the Capital Development Authority (CDA) has allegedly been allotting plots on natural drains and waterways.
Justice Raja Inam Amin Minhas presided over the hearing and sought complete details of the plots from the CDA.
The court observed that the civic authority must explain, along with the layout plans, how it managed to allot residential plots on water channels and drains. Justice Minhas directed the CDA to provide a detailed report on the matter to the court in the next hearing.
During the proceedings, Advocate Kashif Ali Malik appeared on behalf of the petitioners. He argued that despite repeated flooding in Islamabad, the CDA continues to allocate plots on waterways and natural drains. He added that this practice has led to several residential areas being submerged in recent days.
The petitioners’ counsel maintained that such allotments not only violate planning standards but also endanger the lives and properties of residents. He emphasized that the reckless actions of the civic body have worsened flooding in low-lying areas, putting local communities at risk.
The court adjourned the case until October 16, directing the CDA to submit the layout plans along with full details of the plots allotted on waterways before the next hearing.

Absolutely right. I have also observed that a large numbers of plots have been developed in water channel at different locations by CDA. However, being resident of Sector I-14, I have observed that lot numbers of plots developed in sector I-15/4 are within the water channel, resulting in wastage of public funds on infrastructure such as recently constructed roads and other services, which have now been washed away during the this monsoon season.
It has further been learnt that these plots were intentionally developed and allotted within the nullah/water channel under influence. Later, requests were generated to CDA, stating that the plots fall in a depression or water channel, thereby seeking compensation in the form of relocation to prime areas of already developed sectors.
Subsequently, these plots are often sold to buyers with limited budgets, who then face severe consequences, such as poor drainage and recurrent flooding.
This entire matter calls for a thorough investigation to safeguard public resources and protect citizens from such malpractice.

It is vague statement that CDA develops residential plots in water ways & Nullahs. The petitioner should specifically indicates plots which lie on the water way.
The issue is that existing water ways are unable to cope with the flow of more water as a result of flooding and cloud bursting..It is natural phenomena and calls for replanning.
