Supreme Court Rules Against Forced DNA Testing

The Supreme Court of Pakistan has ruled that compelling an individual to undergo a DNA test is a clear violation of fundamental rights, stating that such orders undermine personal dignity and cannot form part of routine legal proceedings.

In a landmark judgment, the apex court set aside orders issued by the Lahore High Court and a Special Judge Anti-Corruption in Pakpattan, which had directed citizen Khalid Hameed to undergo a mandatory DNA test.

The court held that forcing DNA testing in cases involving paternity disputes or alleged document tampering amounts to a blatant breach of constitutional protections.

According to the written verdict authored by Justice Muhammad Hashim Khan Kakar, DNA testing is an extremely sensitive and private medical procedure.

The court ruled that it can only be ordered in specific criminal cases, such as rape or sexual offences, where the law explicitly provides for it.

The Supreme Court observed that no such legal justification existed in the present case, reinforcing that personal dignity and privacy remain inviolable under the Constitution.
