Supreme Court Rules Husband Must Pay Haq Mehr in Full

Chief Justice of Pakistan Yahya Afridi has ruled that a husband is legally bound to pay all items mentioned in the haq mehr (dower) as recorded in the marriage contract.

A two-member bench headed by the Chief Justice heard several petitions related to dowry and haq mehr.

During the hearing, the petitioner’s counsel argued that 40 tolas of gold mentioned as haq mehr was excessive and said his client was willing to pay only 20 tolas.

In response, the Chief Justice remarked that a slight increase might encourage the woman to agree to a settlement, adding that courts cannot interfere with such personal agreements.

The Chief Justice observed that when a man enters into marriage, he is bound by the terms of the nikahnama.

“Once you marry a woman, payment under the marriage contract becomes mandatory,” he said, emphasizing that the husband must fulfill all obligations mentioned in the haq mehr.

Following the hearing, the Supreme Court dismissed multiple petitions related to dowry and haq mehr disputes.
