LHC Declares Women Can File Khula and Haq Mehr Cases

The Lahore High Court (LHC) has ruled that a woman can file a khula and dower (Haq Mehr) case in the district where she resides, calling it essential for convenience and access to justice.

Justice Malik Muhammad Awais Khalid issued the six-page judgment while deciding a petition filed by Ayesha Nasir.

In the ruling, the judge stated that allowing a woman to pursue a case near her residence makes legal proceedings easier and ensures better access to justice.

During the hearing, the petitioner asked the court to transfer her case from the Family Court in Jaranwala to Lahore. She told the court that her husband, Aun Abbas, had already filed a case in the Family Court of Faisalabad.

After reviewing the matter, the court emphasized that women should be able to file family cases in the district where they live to avoid unnecessary hardship and to ensure smoother legal proceedings.
