SHC Orders Daily Wages and Temporary Services to Be Included in Pension

The Sindh High Court’s (SHC) constitutional bench has ruled that service performed on daily wages and temporary basis must also be counted toward pension, declaring Civil Aviation office orders to the contrary illegal.

The court issued the ruling while hearing a case related to the service period of retired Civil Aviation employees. It struck down the departmental orders that excluded previous service from pension calculations and directed authorities to pay all outstanding dues within two months.

During the hearing, counsel for the petitioners told the court that the employees had started working on daily wages between 1998 and 2001 and were later regularized in 2009. However, after retirement, their earlier service was not included in pension calculations.

The bench observed that pension is a legal right of retired employees and that ignoring previous service is unlawful. It further held that an administrative condition cannot take away a basic right available to employees.

The court ordered authorities to recalculate pension benefits by counting the entire length of service and clear all pending dues within two months.
