Sindh High Court Rejects Job Plea Due to Dual Domiciles

The Sindh High Court (SHC) on Tuesday dismissed a petition filed by a candidate seeking appointment as a primary school teacher, ruling that he was ineligible for the post due to holding dual domiciles.

During the hearing, the petitioner’s counsel argued that his client had passed the recruitment test for the post but was denied an appointment letter on the grounds of possessing two domiciles.

The lawyer stated that the petitioner had later cancelled his Punjab domicile after relocating to Karachi and alleged discrimination in the recruitment process.

However, the prosecutor informed the court that the petitioner’s Punjab domicile was cancelled in September 2024, while the application deadline had already expired in April 2021.

Therefore, he did not meet the eligibility criteria at the time of application.

The court observed that under the law, a citizen is entitled to only one domicile and one Permanent Residence Certificate (PRC), and there is no legal provision allowing multiple domiciles simultaneously.

The SHC further noted that the petitioner had failed to provide accurate information during the application process and had concealed material facts, including an active domicile from another province.

The court also referred to official records indicating that the earlier domicile remained valid during the recruitment period.

In its judgment, the court ruled that providing incorrect information and submitting a false affidavit were sufficient grounds for disqualification. Consequently, the petition was dismissed.
