As Shahrukh Khan and his family breathe a sigh of relief, the fam threw a party to celebrate Aryan Khan’s bail and return home.

Earlier in October, the star kid was arrested by Narcotics Control Bureau (NCB) in a case related to possession of contraband. The initial bail for The Lion King Hindi dubber was rejected leading to a time-consuming process for bail. SRK and Aryan Khan’s lawyers had to file for bail in a special court.

Luckily after a few court hearings, Aryan is now home. It was the Bombay High Court that finally cut the star kid some slack.

Both Aryan Khan and co-accused Arbaaz Merchant and Munmun Dhamecha were released on bail. Previously a special NDPS court rejected their bail plea in the cruise ship drug bust case.

Opposing the bail plea in HC, the NCB counsel, ASG Anil Singh said applicant Aryan Khan is not a first-hand consumer but a regular consumer of drugs for the last two years. He also pointed out that Aryan was found in ‘conscious possession’ of contraband.

“There is a case that a person might not have consumed the drug, but if he’s in possession of it, he can be booked under NDPS, accused Aryan was found in conscious possession of contraband.”

Despite, film and drama glamorizing the use of contraband in India, the country has rather strict possession and narcotic use laws.

Meanwhile, a day earlier, Senior Advocate Amit Desai, representing co-accused and Aryan’s friend Arbaaz Merchant, argued before the single-judge bench of Justice Nitin W Sambre that the NCB’s arrests in the case were ‘illegal’ because the agency failed to follow the procedure under section 41A of the Criminal Procedure Code (CrPC).

This law mandates the investigating officer issue notice of appearance prior to arrest. Desai also contended that WhatsApp chats were not admissible in court, according to previous High Court judgments and provisions of the Indian Evidence Act.
