SHC Issues Notices Over Illegal Constructions in North Nazimabad Area

KARACHI: The Sindh High Court (SHC) has issued notices to the Sindh Building Control Authority (SBCA), the District Central deputy commissioner, and other relevant parties in response to a petition filed against illegal constructions in the North Nazimabad area.

In the petition, Ghulam Mustafa and others raised concerns about the SBCA officials permitting the construction of high-rise buildings and shopping malls.

They also pointed out the conversion of residential land into commercial areas in North Nazimabad Block B, which goes against the approved building plan and other by-laws.

Furthermore, the petitioners disclosed that they had previously applied to the relevant authorities, highlighting the issue of private builders raising high-rise constructions in residential zones without proper approval of the building plan.

They further alleged that these private respondents illegally converted KDA plots into Khando Goth KMC, obtaining illegal and forged leases in their names.

Additionally, they accused the private respondents of encroaching on 50 feet of a road for their construction activities.

Their counsel stated that the Katchi Abadi land director was informed about the illegal construction, but no action was taken in response.

Moreover, the petitioners claim that the original master plan of the area has been disrupted due to illegal constructions of godowns, shopping plazas, and shops by these private builders, with the approval of SBCA and local government officials.

The high court has been requested to direct the SBCA, Karachi Metropolitan Corporation, and others to intervene and prevent the private builders from continuing their illegal constructions on KDA land.

In addition to seeking restraint on further construction, the petitioners have also asked for the cancellation of forged leases issued to the private respondents by the Sindh Katchi Abadi Authority.

The division bench of the high court, led by Justice Adnan Iqbal Chaudhry, has taken up the preliminary hearing of the petition and issued notices to the advocate general, SBCA, Sindh Katchi Abadi Authority director, and other relevant parties, requiring them to file comments on the matter.
