ISLAMABAD: On Thursday, the Supreme Court of Pakistan restored Park View City Islamabad’s suspended No Objection Certificate (NOC), discarding the order to file a case against the society.
As per the details, the case was heard by a 3 member SC bench, led by Chief Justice Umar Ata Bandial.
During the proceedings, the court issued an order directing the head of the Capital Development Authority (CDA) to investigate the facts surrounding the land owned by Park View City and submit a report.
The Chief Justice questioned CDA why the civic body did not provide compensation to the victims, adding that CDA had spent billions of rupees improving Islamabad’s roads but the victims of the 1960s were still not being compensated, he continued.
According to the CDA lawyer, the victims filed an application for the registration of a case against the occupation of the land.
The lawyer further stated that the CDA was under no obligation to provide Park View City with land for a road. If it does so, every society would ask for the land, he added.
He further stated that if Park View City had purchased land and built a road, the CDA would issue an NOC.
Justice Ayesha Malik responded that the victims had also filed a civil case, and wondered how civil litigants could file a constitutional petition with the Supreme Court.
The Supreme Court remanded the case to the Chairman of the CDA and stayed the previous orders regarding the cancellation of the NOC and the registration of the case.
