A coalition of immigrant rights groups and U.S. citizens has filed a federal lawsuit challenging the Trump administration’s freeze on immigrant visa processing for nationals of 75 countries, including Pakistan, Bangladesh, Brazil, and Albania.
The policy, effective January 21, pauses immigrant visa issuance indefinitely while exempting nonimmigrant visas.
The plaintiffs argue the policy unlawfully discriminates based on nationality and race, overturning decades of settled U.S. immigration law.
They claim the State Department’s justification, that affected nationals are likely to become “public charges”, is false and unsupported.
The lawsuit seeks to restore individualized visa processing and block the policy nationwide.
Petitioners include U.S. citizens whose family members have been denied visas despite prior approval.
Nonprofit organizations such as the National Immigration Law Center and Democracy Forward argue the policy tears families apart, blocks workers critical to the economy, and revives a discredited rationale for broad-based immigration restrictions.
The U.S. State Department defended the freeze, stating it aims to prevent public benefits misuse and improve screening procedures, emphasizing that visa issuance prioritizes American taxpayers’ interests.
