Women Allowed to End Marriage If Husband Disappears for 2 Years

The Council of Islamic Ideology (CII) has stated that a woman can approach a court to seek dissolution of marriage if her husband remains missing for two years.

According to a report published in the Daily Jang, the CII reviewed laws related to dissolution of marriage (Faskh-e-Nikah) and, in principle, agreed with recommendations put forward by a special committee formed to address gender disparity in existing provisions.

The council maintained that a woman may file a petition for annulment if her husband has been missing for two years, or if he has been imprisoned for three years.

It further said that if a husband is unable to fulfill marital obligations, or if he is suffering from serious conditions such as mental illness, cancer, or similar diseases, a woman may submit a request for dissolution after waiting one year.
