The Capital Development Authority has issued a strict notice to Roshan Pakistan Housing Society, warning that unauthorized construction in its E 16 Zone 2 project could face demolition unless regulatory requirements are fully met.
The authority stated that restoration of the cancelled NOC and layout plan will only be considered after complete compliance with codal formalities, including verification of land records, public notices for objections, submission of undertakings, and payment of scrutiny fees along with a restoration charge of Rs. 2,000 per kanal.
CDA emphasized that any construction carried out in violation of approved plans or regulations is illegal and will not be protected under the law. It cited rulings of the Islamabad High Court and Supreme Court affirming that the authority has exclusive jurisdiction over approvals and enforcement.
The society has been directed to submit all required documents within seven days, failing which its request will be treated as rejected. The authority also warned that enforcement responsibility extends to local administration, including the Chief Commissioner, Deputy Commissioner, police, and magistrates.
Further, CDA instructed that all funds collected from allottees must be deposited within three months and that no construction activity should proceed without prior approval. Any alteration of public utility areas such as parks, mosques, schools, or playgrounds may lead to cancellation of layout plans and possible takeover of assets and bank accounts.
The notice also mandates that all future plot allotments must strictly follow approved layouts, with societies required to submit undertakings ensuring no deviations or conversions. CDA said enforcement actions will be carried out under Section 49 C of the CDA Ordinance 1960 and relevant zoning regulations to ensure compliance.
