General Pervez Musharraf has been found guilty under high treason charges by the High court of Islamabad under Article 6 of the Constitution of Pakistan. For those who are unaware, Article 6 is states that anyone who tries or conspires to abrogate or suspend the constitution by show of force or use of force or by any other unconstitutional means, is guilty of high treason. It also calls on parliament to punish people found guilty of it.

One judge, Waqar Ahmed Seth had some remarks regarding the judgement he was part of, which have landed him in controversial waters.

Crimes of Musharraf

Former President General Pervez Musharraf  wassentenced to death by court for subverting the constitution in 2007 when he imposed a state of emergency in the country, causing chaos by putting senior judges on high arrest. He reinstated the constitution on December 2007. And in 2009, the Supreme Court ruled that Musharraf’s actions to impose the emergency act was illegal.

In 2013, the Sharif government brought charges of high treason against him for imposing the 2007 emergency.

A special court handed over death penalty to former President Pervez Musharraf. This made Musharraf the first military ruler in history to receive capital punishment in the history of Pakistan.

Musharraf is currently residing in Dubai and has refused to stand trial in court, despite multiple orders. He claims that he is being victimized.

Unlawful?

The decision regarding the death penalty and how it should be carried out has become a nationwide outrage.

One of the three judges from the special court who passed judgment has drew ire and extreme disgust from the public by proposing the public hanging of the former president.

The judge’s name in question is Waqar Ahmed Seth.

Para 66

A specific paragraph from Judge Seth’s observations has gone viral over social media. Here’s what the judge noted in his detailed judgement:

“We direct the law enforcement agencies to strive their level best to apprehend the fugitive/convict [Pervez Musharraf] and to ensure that the punishment is inflicted as per law and if found dead, his corpse be dragged to the D-Chowk [in front of the Parliament House], Islamabad, Pakistan, and be hanged for three days.”

Waqar Ahmed Seth has received backlash for his ‘controversial’ ruling from the government as well as the army itself.

He was questioned recently by a lawyer, who asked him about the backlash. Seth surprisingly had a humorous tone about it.

“I don’t watch TV… I only watch wrestling,”
