Supreme Court Orders NAB to Remain Within its Legal Limits

The Supreme Court (SC) has ordered the National Accountability Bureau (NAB) to stay within its legal boundaries while pursuing any case.

The two-member bench comprised of Justice Mushir Alam and Justice Munib Akhtar was hearing a plea at the SC’s Karachi registry filed by Humair Associates.

During the proceedings, the petitioner’s counsel Advocate Ghulam Shabbir Baloch argued that NAB was harassing his client, Humair Associates. He asked the court to bar NAB from taking action against his client.

The court observed that no state department, including NAB, was allowed to take illegal measures to probe the case.

Justice Alam, however, remarked that the court will not restrict the bureau from taking legal actions.

The defense counsel apprised the bench that the NAB officials harassed his client on the phone, and threatened to arrest him without any call-up notice, which was against the law.

“My client’s office was sealed without any notice,” he said, adding that the petitioner had also requested a plea bargain in one of the cases.

The court, while disposing of the plea, directed the corruption watchdog to refrain from taking illegal action against the plaintiff and function within the legal boundaries.

About the Case

Humair Associates had launched two housing projects in Scheme 33 of KDA in 2010. They collected money for the construction of houses but didn’t alott the plots to the owners.

Resultantly, more than 100 people registered their complaints with NAB. The bureau took up the case, but the inquiry slowed down during PPP’s era.

In 2014, Humair Associates requested for a plea bargain in two references – Sachal Sarmast and Rumi residential projects.

Humair’s partner, Rumi Builder’s affidavit is with the court; which says that all claimants will be compensated as per the law.
