The National Accountability Bureau (NAB) has initiated an inquiry into allegations of authority misuse by the senior special magistrate and deputy commissioner of the Capital Development Authority (CDA) regarding the Built-up Properties (BUP) award in sector C-13.
In a letter to the CDA chairman, NAB stated, “The Bureau is conducting an inquiry under the National Accountability Ordinance, 1999, into allegations of misuse of authority related to the illegal awarding of Built-up Properties in Sector C-13 of CDA.”
It added, “The inquiry revealed that CDA acquired 740 Kanal and 1 Marla of land in Sector C-13 through an award dated December 12, 2008, and the Built-up Properties award was announced on August 17, 2013.”
On July 25, NAB requested detailed information including the land acquisition order, the full award details for the Built-up Properties (BUP), the list of landowners and their properties before the 2008 award, records of price assessment committee meetings, geological and geographical mapping of Sector C-13, and a complete service profile of Sardar Asif Ali, Deputy Commissioner of CDA.
On June 7, NAB notified the CDA chairman about the inquiry and requested the appointment of a focal person to assist with coordination and the review of records.
On Wednesday, the magistrate contested NAB’s inquiry in the Islamabad High Court. The petition argued that as a senior magistrate, the petitioner’s judicial decisions should not be subject to investigation by NAB, as it constitutes interference in judicial matters.
The division bench, led by Justices Miangul Hassan Aurangzeb and Arbab Mohammad Tahir, was set to hear the petition. However, the magistrate’s lawyer informed the court on Thursday that the petition would be withdrawn, leading to its dismissal.
In October 2022, the magistrate had leveled serious allegations against the top officials CDA in an application field in the IHC. He claimed he was pressured to extort money and described his court as being treated like an “ATM.”
He alleged undue influence and interference in cases related to CDA Ordinance 1960 and other laws, which he argued violated natural justice principles.
