The Lahore High Court has delivered a landmark ruling regarding child custody, declaring that a mother remains entitled to custody of her child even after remarriage.
Justice Ahsan Raza Kazmi issued a four-page written judgment in response to a petition filed by Nazia Bibi. The court overturned a decision by a trial court that had transferred custody of a 10-year-old boy from the mother to the father solely on the grounds of the mother’s second marriage.
The judgment emphasized that a child’s welfare must be the primary consideration in custody cases. While it is commonly believed that a mother loses custody rights after remarriage, the court clarified that this is not a hard-and-fast rule. In exceptional circumstances, a mother may still retain custody if it serves the child’s best interest.
The court observed that in this case, the child had been living with his mother since birth. Stripping her of custody just because she remarried was not a justifiable decision. The ruling also noted that such harsh decisions could have a deeply negative impact on a child’s development and well-being.
The judgment also pointed out that the couple had separated in 2016, but the father only filed for custody in 2022. He failed to provide any reasonable explanation for this six-year delay. The court remarked that the father appeared to have initiated the custody case only after realizing he might lose a financial support claim filed by the mother.
The High Court ruled that the trial court had overlooked key issues, and therefore, its decision to grant custody to the father was declared null and void.
