24NewsHD TV channel reported that the Supreme Court ruled on Monday that a daughter is eligible for a government job if her father passes away.
A two-judge bench, comprising Justice Mansoor Ali Shah and Justice Athar Minallah, delivered the verdict in a case where a woman was dismissed from her job following her father’s death.
Justice Mansoor Shah emphasized that a woman’s economic independence is unrelated to her marital status. “If a son remains his father’s heir after marriage, why not a daughter?” he questioned.
The Khyber Pakhtunkhwa (KP) Advocate General argued that, as per a ruling by former Chief Justice Qazi Faez Isa, children of government employees cannot be given jobs on a priority basis.
In response, Justice Mansoor Shah pointed out that Qazi Faez Isa’s verdict was issued in 2024, whereas this case predates it. “The 2024 ruling does not apply to older cases,” he clarified.
The KP Advocate General further contended that the woman was dismissed from service after getting married, rendering her ineligible to take her father’s place.
Justice Mansoor Shah questioned the legal basis for her ineligibility after marriage. The KP Advocate General replied that her removal was carried out through a notification under the KP Civil Service Act.
The Supreme Court accepted petitioner Zahida Parveen’s plea and disposed of the case, stating that a detailed verdict would be issued later.
