Lahore High Court Gives Historic Ruling About Dowry After Separation

The Lahore High Court has ruled that a woman remains entitled to her full deferred dower even after obtaining a divorce through Khula, if the separation is due to her husband’s misconduct.

Justice Raheel Kamran emphasised that under Islamic law and the Nikahnama, which serves as a binding contract, the husband is obligated to pay dower unless the wife seeks Khula without fault on his part.

In the case at hand, the woman provided credible evidence of cruelty and disrespect, prompting the court to uphold lower court rulings in her favour. The judge explained that when Khula is granted due to the husband’s bad conduct, the woman retains her right to both prompt and deferred dower.

However, if a woman seeks separation merely due to dislike, the dower may be returnable — subject to judicial discretion based on case facts.

Justice Kamran further noted that dowry remains a deep-rooted social practice and that Khula is supported by Islamic teachings and historical precedent. He concluded that since the marriage lasted nine years and the wife fulfilled her obligations, denying her the dower would be unjust.

The husband’s petition challenging the decisions of the Sahiwal district courts was dismissed.
