Supreme Court Settles Property Dispute Pending Since 1955

The Supreme Court of Pakistan has settled a 71-year-old family dispute, delivering a landmark judgment that reaffirms inheritance as a vested Sharia and legal right that devolves upon all heirs—including women—immediately upon the death of a family head.

Heading a two-judge bench, Justice Shahid Bilal Hassan set aside a 2017 Lahore High Court judgment, ruling that inheritance rights cannot be defeated through social pressure, dubious revenue entries, or private arrangements.

The court declared a 1955 mutation involving an alleged verbal gift from a widow and daughters to two sons as illegal, void, and fraudulent.

The court observed that the law of inheritance serves as a divine scheme for wealth distribution and economic justice. Justice Hassan noted that the right to inherit is not a “bounty” to be granted at the pleasure of male family members, nor is it a concession dependent on custom.

The judgment stressed that once a gift is challenged, the burden of proof shifts to the beneficiaries to demonstrate its lawfulness.

Highlighting a persistent societal issue, the court remarked that women are often pressured to surrender their rights in the name of tradition or family honor. The SC directed revenue authorities to correct records and ensure the lawful separation of shares for all heirs.

The ruling serves as a strong reminder to courts and revenue officials that the legal system must protect rather than defeat the inheritance rights of women, ensuring constitutional values and Islamic principles are upheld.
